PUBLIC OFFER AGREEMENT
For the Provision of Services
Individual Entrepreneur Sliusarenko Anastasiia Petrivna, acting on the basis of an Extract from the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Associations, hereinafter referred to as the "Contractor", on the one hand, and the person who has joined this Agreement by accepting the offer to enter into this Agreement on the terms determined by the Contractor, hereinafter referred to as the "Customer", on the other hand, hereinafter collectively - "Parties", and each separately - "Party", expressing their free will and guided by the norms of the current legislation of Ukraine, have concluded this Agreement for the Provision of Services (hereinafter - "Agreement") as follows:
1. GENERAL PROVISIONS
1.1. This document is a public offer and public agreement. In accordance with Articles 633, 641 of the Civil Code of Ukraine, its terms are the same for all Customers, and unconditional acceptance of the terms is considered acceptance of this offer by the Customer.
1.2. In accordance with Part 2 of Article 642 of the Civil Code of Ukraine, acceptance of this offer is the registration and full payment of the order on the website or through agreed communication channels, which is equivalent to concluding a public agreement for the provision of services.
1.3. From the moment of payment, the Customer confirms that they are fully familiar with and agree to all terms of this offer and confirm that they understand the content of the Agreement and the legal consequences of its conclusion.
2. SUBJECT OF THE AGREEMENT
2.1. The subject of this Agreement is the individual tailoring of textile products, namely dresses and corsets, hereinafter - "products".
2.2. Each product is handmade and is a unique, non-serial product.
3. ORDER PLACEMENT AND MEASUREMENTS
3.1. To place an order, the Customer is obliged to provide accurate and correct individual measurements in accordance with the Contractor's instructions, which are attached before payment.
3.2. The Contractor is not responsible for the fit, comfort or appearance of the product if the measurements were made by the Customer improperly and not according to the contractor's instructions, or provided incorrectly, inaccurately or with errors.
3.3. The full scope of risks associated with incorrect, inaccurate or erroneously transmitted measurements is borne by the Customer.
4. APPEARANCE OF THE PRODUCT
4.1. The appearance of the product, including fabric shades, material texture, decorative elements and fittings, may slightly differ from the images presented on the website or social media.
4.2. Such differences may be due to lighting features, screen settings, handwork and individual tailoring and are not grounds for return or exchange.
5. FITTINGS AND CORRECTIONS
5.1. Individual tailoring is carried out without fitting based on measurements and information provided by the Customer.
5.2. The possibility of corrections is determined individually and is not the Contractor's obligation.
5.3. Corset products are not subject to alteration, reworking or design changes after completion of manufacturing.
6. COST AND PAYMENT
6.1. Full payment is made immediately before the start of product manufacturing by non-cash transfer of funds based on an invoice issued by the Contractor.
6.2. After the start of product manufacturing, order cancellation and refund are not possible.
7. PRODUCTION TIME
7.1. The estimated production time is up to 1 (one) month.
7.2. Production times may be changed in case of delays in material supply, high workload or force majeure circumstances, of which the Customer must be notified within 5 days.
8. DELIVERY
8.1. Delivery is carried out worldwide, except to the Russian Federation and the Republic of Belarus.
8.2. For international orders, the cost of delivery is included in the total cost of the product.
8.3. Customers from Ukraine pay for delivery separately.
8.4. For international delivery, the Contractor indicates the full estimated value of the product.
8.5. All customs fees, taxes and duties arising from the import of the product are paid by the Customer in accordance with the legislation of the recipient country.
8.6. The Contractor is not responsible for delivery times after handing over the product to the carrier.
9. RETURNS AND EXCHANGES
9.1. Products made to individual measurements are not subject to return or exchange.
9.2. Corset products cannot be reworked, altered or structurally modified.
9.3. Returns are possible only in case of confirmed manufacturing defect.
